Minutes

January 12, 2010

 

Present: Lauren Bressett, Laurie Burt, Jim Starkey, Bob Harcke, Bruce Smith, Nancy Zeller, Russ Kotfila, Jim Ranson.

 

Members of the public were present.

 

Lauren Bressett called the meeting to order at 7:03PM.

 

Lauren notified the members of the public in attendance that the Cersosimo Industries hearing will be continued at the joint hearing with the Zoning Board on January 27, 2010 at 7:00PM, as noticed.

 

Minutes of December 8, 2009:  Corrections are: Cersosimo Industries, page 2, line 8: 2) noted that in one instance the excavation is at 150’ in the grandfathered excavation, and this buffer will be maintained. Page 2, line 11: …regulated by the NHDES. Page 2, line 14: …Mr. Cersosimo stated for 2009, sales slips indicated the peak month was June. The average for June was 16 trucks per day.  If you were to take out the one highest day, and the one lowest day, the average for June would be 14 trucks per day. Page 2, line 17: …so that traffic will stay similar to what it is currently. Page 3, line 16: change Tina Cutter to Tina Blanchard.

Laurie Burt motioned to accept the minutes as read and corrected.  Jim Starkey seconded, motion carried unanimously.

 

New Business:           

                                                                                               

Earle and Linda McClening:  Application for a minor subdivision. Jim Starkey asked Mr.  McClening if anything on the map had changed. Mr. McClening stated that nothing had changed.  Mr. McClening explained that his intentions for the subdivision are so that his daughter can build a home in the future.  Mr. McClening is joined by Russ Huntley, SVE, as an authorized representative. The application was reviewed using the Westmoreland Minor Subdivision Checklist. 1,2,3,4, complete. 5) location of property lines.  Mr. McClening stated that in fact his property is two lots, not currently represented on the Tax Map.  Map 9 Lot 31, 17 acres and Map 9, Lot 31A, 60 acres. He provided the Board with the two property deeds and his two tax bills.  The Board stated that an up-dated plan is needed showing the property boundary lines. 6,7,8, complete. 8) The new map requested for item 5, needs to show the existing excavation. Mr. Huntley showed a revised map with the excavation location noted. 9,10,11,12, complete. 13)  Lauren Bressett stated that it appears that a slight amount of the back lot is protected by the Shoreline Protection Act, and that DES approval would be needed. There was discussion between Mr. McClening, Mr. Huntley, and Board members about re-drawing the lot to be subdivided. Jim Starkey asked if redrawing the back line would eliminate the questions on items 5, 8 and 13 of the checklist. The board agreed it would. Mr. McClening stated that he was willing to have the lot reconfigured.

 

Jim Starkey moved to accept the application as complete subject to the lot line being re-drawn to follow the boundary of Lot 31 on Map 9.  Laurie Burt seconded, all voted in favor.

 

Lauren Bressett asked for questions of board members. Nancy Zeller asked Chair, Lauren Bressett, if the letter received by Board members, written by Pamela Martens needs to be accepted as part of the review.  Lauren stated that the letter from Mrs. Martens is referring to the excavation on the back lot, R9-31A, does not apply to the matter of the Minor Subdivision of R9-31 before the Board and has no bearing on the Board’s decision. 

 

Lauren opened the hearing for abutter and public comment, stating that approval has not been given and will not be until a review of a revised map has been done by the Board.  Robert Mitchell, abutter, stated that he has no objections to the McClening subdivision request.  Walter Derjue asked for clarification revolving around the Shoreline Protection Act and DES approval. 

 

Discussion was opened to the Board members.  Lauren voiced concern about the narrow strip of land (dog leg) that makes up the majority of road frontage. Some discussion ensued. All other members did not feel that the “dog leg” is or would be a problem in the future. The board indicted general agreement with the subdivision but needs to see the final maps.

 

Russ Kotfila moved to continue the McClening hearing at the February 9, 2010 meeting of the Planning Board, subject to the final maps being submitted.  Jim Starkey seconded. All voted in favor.

 

Budget:  Lauren gave a brief review of the 2009 budget.  Bob noted that the Board may need some professional assistance re-writing the ordinances that need up-dating.  Discussion ensued around the need for adding money to the proposed budget to cover the expense.  Members discussed the need for additional work meetings to complete ordinance work being done.

 

Jim Starkey moved to level fund the budget for 2010.  Bruce Smith seconded. All voted in favor.

 

Selectmen Update:  None

 

Letters:  Board members had the opportunity to look at the copies of letters received from the Tax Collector.  All members were given a copy of the letter received from SWRP. All members had received the packet of materials from Pam Martens regarding Cersosimo which will be held for the January 27 hearing.

 

OLD BUSINESS:   Board members sorted thru old maps in storage in an effort to organize and make sure that maps that should be in Planning files are.

 

The Board amended the Westmoreland Planning Board Rules of Procedure to read as follows:  6.3. h. Other business. 10.2 The applicant or agent shall be called to present the proposal. 10.3 Abutters shall be allowed to speak. 10.4  Other parties such a representatives of town departments and other town boards and commissions who have a interest in the proposal shall be allowed to present their comments in person or in writing. 10.5  Others who wish to comment shall be allowed to speak briefly. If necessary, commentators will be limited to 3 minutes.

 

Laurie Burt moved to adjourn the meeting. Russ Kotfila seconded. All voted in favor.
