WESTMORELAND ZONING BOARD MEETING

April 10, 2007  - 7:30 PM

 

Present:  Peter Remy- Chair, Brenda Shelley, Barry Shonbeck, John Burt, Brian Merry, and Russell Huntley.Alt.

Chair Peter Remy called the meeting to order at 7:45 PM.  This meeting was a Joint Meeting with the Planning Board.

 

Russell Huntley was representing Broadridge LLC, is requesting a five lot subdivision from the Planning Board and is requesting from the Zoning Board a Special Exception to allow one common driveway off Hurricane Road.  The proposed curb cut would be between existing walls.  There is an easement across R13 Lot 8D which goes to R13 Lot 8-E.This would mean entering on Map R13 Lot 8-D, going across R13 Lot 8-D to another lot Map R13 Lot 8E.  Mr. Huntley stated the first 100 feet would be the common driveway then it would branch off to each respective lot.  The ability to have shared driveways is allowed by Special Exception.

 

Butch Castor, a member of the audience requested if the subdivision should be approved before the Special Exception.  Chairman Remy stated the Special Exception should be done first then Mr. Huntley should go before the Planning Board for a Subdivision.  Barry Shonbeck questioned why a “shared driveway” was requested when it appears both lots have an access on Class 5 roadway.  Mr. Huntley explained to have a shared driveway at property line of Lot 8D and Lot 8>>>> would not work as there is wetland and is very steep coming in from the Hurricane Road on Map 13 Lot 8E.  When questioned regarding grade Mr. Huntley stated it was over a 15% grade.  When questioned about putting the drive at the lower end of the lot of R13 Lot 8E, Mr. Huntley stated a driveway could be put there but it would make for a very long driveway as a proposed house would be closer to lot 8D property line. 

 

Becky Kiritsy, a member of the audience, questioned repairs, maintenance, etc. for a shared driveway, and would it reduce the value of the property.  The Board stated repairs, etc. would be between the owners of the property.

 

There was discussion with the Planning Board regarding the new ordinance which states a driveway curb cut must be on a Class 5 road.  The new ordinance regarding “shared driveways” does not indicate if the driveway is meant to be on the property line of the two lots or as this proposed shared driveway, cutting through one lot go obtain access to another lot.

 

No decision was made by the Zoning Board at this time and Chairman Peter Remy adjourned the meeting to May 8, 2007 at 7:30 PM at the Town Hall.  This will give the Board time to obtain clarification of the Shared Driveway Ordinance.
