ZONING BOARD OF ADJUSTMENT

Meeting of May 28, 2008

 

 

Present:  Chair Peter Remy, John Burt, Brian Merry, Brenda Shelley, Barry Shonbeck, and Alternate Russell Huntley. In the Audience:  Jan Bakalar, Vincent Dolan, and Rory Nolan.

 

Chair Peter Remy called the meeting to order at 7:30 PM and informed the Board there was one hearing set for the evening.

 

JAN & MARY BAKALAR – VARIANCE REQUEST

Mr. Jan Bakalar explained to the Board he is would like to build a house at 58 Hurricane Road, Map R13, Lot 8B.  The house will have a deck.  Mr. Bakalar is requesting a variance to place two deck piers within the 75 foot wetlands buffer.  If he moves the house further up the property it will be very expensive for fill. The Board viewed the maps prepared by Russ Huntley of Land Resources.  The Board also read a letter from the Westmoreland Conservation Commission, signed by Marshall Patmos, which states that in viewing the property the Conservation Commission has no concerns with the piers being placed with the 75 foot wetlands buffer.

 

The Board reviewed the five criteria for a variance. As all five criteria were met the Board moved to vote on the variance.  At this Russ Huntley recused himself.

 

Barry Shonbeck moved to approve the variance, seconded by Brenda Shelley.  All in favor, so moved.

 

 

RORY NOLAN was in to discuss her options for making the Hillcrest Nursing Home (former Cedarcrest Nursing Home on Aldrich Road) into a four family apartment house. Ms. Nolan showed the Board a proposed sketch of plans and explained what the apartments would look like and their size.  Each apartment would be one bedroom apartments.  The building is in the Rural Residential Area.  The Board explained to Ms. Nolan she would need to first meet with the Zoning Administrator, then would have to submit paperwork to the Zoning Secretary so a hearing could be set.  Ms. Nolan was informed to meet with the Zoning Administrator and Zoning Secretary then next day, March 29, at 9:30 am in the Selectmen’s Office to begin the process for a hearing with the Zoning Board in June.  The Zoning Board Secretary will pull the file and research how the property has been used in the past and what permits have been issued.

 

 

VINCENT DOLAN –representing Cedar Knoll Inc., met with the Board to discuss what would have to be done to make a building at 35 Old Route 12 North into a residence, and also what would need to be done to use the “barn/shed” for an excavation business.  At this time the “barn/shed” is being used for an auto repair business.  Mr. Dolan explained the parents would live in the house and the son would run the exaction business.  The Board informed Mr. Dolan research would have to be done on the premises before any decision could be made.  Zoning Secretary will pull the files on the property and give to the Zoning Board Chair for review.

 

As there was no further business before the Board, Chairman Peter Remy adjourned the meeting at 8:45 PM
