Zoning Board of Adjustment

Minutes of June 12, 1007

 

 

Present:  Peter Remy, Russell Huntley, Brenda Shelley, John Burt, Barry Shonbeck, Elaine Moore, Arthur Burt, Tom Burt, Dot Burt, Anson Burt, and Laurie Burt.

 

The meeting was held concerning a Request from Steven Burt requesting a variance and special exception to Article 4, 414 of the Westmoreland Zoning Ordinance.

 

Applicant proposed to place a driveway off Hartwell Mill Road, a Class six road and request a special exception for a shared drive, using Class 6 Hartwell Mill Road to get to his driveway.

 

John Burt, a member of the Zoning Board recused himself as a board member for the hearing as he is an owner of the land in question.

 

A question was asked of Mr. Steven Burt regarding why he needed a variance as he is at least 90’ feet from the edge of Route 63.  Mr. Burt stated he would like to place the driveway about 10’ beyond the bridge and if he placed the driveway off Route 63 he would have to build another bridge.

 

At this time Laurie Burt spoke to the Board and stated the Notice placed in the paper was not done correctly thereby making the meeting illegal.  She stated all owners of the property must be given on the Notice of hearing and this was not done.

 

Chairman Peter Remy stated a new Notice of Hearing would have to be done for next month and nothing further could be done at this time

 

Chairman Peter Remy moved to close the hearing due to illegal notice in the paper.  Seconded by Brenda Shelly.

 

Meeting adjourned at 7:57 pm.
